Austin Traumatic Brain Injury Lawyer
If a crash, a fall, or another accident caused a brain injury, you may have a claim against whoever was responsible, and early, thorough medical documentation matters a great deal. I am a Board Certified Personal Injury Trial Lawyer at the Law Office of Robert House in River Place, Austin, Texas 78730, and I talk with people with a diagnosed or suspected brain injury, and with the family members trying to work out what comes next.
Hurt in a head injury accident?
A short call costs nothing. Whether you were told it is a concussion or something more serious, I will listen and tell you where you stand.
Who This Page Is For
This page is for people with a diagnosed or suspected brain injury after an accident in Austin, and for the family members and caregivers around them. Many of you are still symptomatic and overwhelmed. Some of you were told it was "just a concussion." You do not need to have everything figured out before you call me.
What a Traumatic Brain Injury Is, in Plain Words
A traumatic brain injury, or TBI, is an injury to the brain caused by a blow, a jolt, or an impact to the head. It can range from a concussion to a severe injury, and symptoms can be delayed, so they may not show up right away. I am a lawyer, not a doctor, and this is not medical advice. If you are worried about a head injury, please see a doctor.

Why Brain Injury Claims Are Hard
Brain injuries are often hard to see on scans, and they are easy for insurers to minimize. The effects that matter most, such as problems with memory, mood, headaches, concentration, and work, can show up or get worse over time. Insurers may point to normal-looking scans, to symptoms that come and go, to the person's "recovery," or to gaps in treatment.
A claim has to document the injury and its long-term effects, not only the emergency room visit. My approach is to document symptoms early and consistently, to help you stay on track with your treatment, to encourage you to keep a symptom journal, and to work with your treating providers.
What a Claim Can Cover
Depending on the facts, a brain injury claim can seek compensation for:
- Medical care, including therapy and follow-up care
- Lost income and reduced ability to earn
- Pain and suffering
- Changes in daily life
- Future care
None of this is a promise about what a particular case is worth. That depends on the person and the facts.
What to Do After a Head Injury
- Get medical care right away, even if your symptoms seem mild.
- Tell every provider about every symptom, including ones that seem small.
- Go to your follow-up appointments.
- Keep a symptom journal.
- Save your records and bills.
- Get the names of witnesses.
Do not give a recorded statement or sign a release before you talk to a lawyer. Those calls and papers are often used to lock in what happened before you know the full picture.
For Family Members and Caregivers
If someone you love has a brain injury, you are probably carrying a lot too. I am glad to talk with you. If you are wondering about your own claim as a spouse or family member, please call me and we can talk it through.
Coverage for Medical Bills
Your own insurance coverage may help with medical bills while a claim is pending. See Texas PIP vs MedPay vs UM/UIM for how those coverages work. I cannot promise that any particular coverage applies to you.
Deadlines Are Strict
Injury claims have strict filing deadlines, and waiting risks losing evidence. I explain the general rules on my Texas personal injury statute of limitations page. Please call me early so we can confirm what applies to you.

Austin Brain Injury FAQ
Can I sue if I have a brain injury from a car accident in Austin?
You may be able to. If another person's carelessness caused the crash, you may have a claim against whoever was responsible. I cannot tell you whether you have one until I hear the facts, and early medical documentation matters a great deal.
What if my scans were normal but I still have symptoms?
Call me anyway. Brain injuries are often hard to see on scans, and insurers may point to normal-looking results. Tell your doctors about every symptom, keep a symptom journal, and follow your treatment so the record shows what you are going through.
What should I do after hitting my head in an accident?
Get medical care right away, even if your symptoms seem mild, and tell providers about every symptom. Go to follow-up appointments, keep a symptom journal, and save your records. Do not give a recorded statement or sign a release before you talk to a lawyer.
How much is a brain injury claim worth?
I cannot give you a number, because it depends on the person and the facts. What drives value depends on the person: the medical care you need, the time you miss from work, your ability to earn in the future, and how the injury changes your daily life.
Can a family member bring a claim?
It depends on the situation. Please call me and we can talk it through. If a loved one died, see my wrongful death page.
