Austin Waymo & Robotaxi Accident Lawyer
Yes — if you were hurt in a crash involving a Waymo or other robotaxi / driverless vehicle in Austin, you can pursue a claim. Who may pay depends on the facts: the vehicle manufacturer, the fleet / operator, another human driver, or a mix. I build any product-liability theory from the evidence in your case file. I am a Board Certified Personal Injury Trial Lawyer at the Law Office of Robert House in River Place, Austin, Texas 78730.
Hurt in an Austin Waymo or robotaxi crash?
A short call costs nothing. I will tell you what evidence to protect and which parties may belong on the claim before you talk to fleet handlers.
Who This Page Is For
This page is for people injured because a driverless vehicle was involved in an Austin-area crash:
- Other drivers hit by or colliding with a Waymo or robotaxi, including Tesla robotaxis
- Cyclists or pedestrians struck by a driverless vehicle near Downtown, campus, or entertainment corridors
- Passengers, if any were aboard at the time
- Families after a serious or fatal AV crash — see my wrongful death lawyer Austin page when a death is involved
It is a practice page for autonomous / robotaxi crashes, not a citywide personal-injury head-term chase and not a geo landing. Human-driver Uber and Lyft claims are a different insurance and liability picture — see Austin Uber & Lyft accident lawyer. Liability After an Austin Robotaxi Crash — High Level
Driverless crashes can involve more than one potential source of responsibility. At a high level, counsel may need to look at:
- The vehicle manufacturer and, when the facts support it, autonomous-system or software providers
- The fleet / operator that put the vehicle on Austin streets
- Other human drivers or road users who contributed to the collision
- Sometimes the injured person’s own PIP, MedPay, or UM/UIM — confirmed from the policy and claim file
Which combination applies is a fact question. Fleet claim handlers are not your lawyer. Their job is to manage the company’s risk. Mine is to protect yours. Product-liability theories, policy limits, and regulatory questions get answered in the investigation of your specific crash. If a vehicle software or hardware defect may have caused the crash, see my Texas product liability lawyer page.
Common Waymo / Robotaxi Crash Patterns in Austin
Patterns I look for first include intersection and left-turn conflicts with autonomous vehicles; pedestrian or cyclist strikes near Downtown, campus, and entertainment corridors where AV traffic mixes with foot traffic; multi-vehicle pileups where a robotaxi is one car in the chain; and unexpected stops or maneuvers that cascade into rear-end impacts. Those facts do not prove liability by themselves. They tell you where to look — vehicle identification, scene video, witness names, the crash report, and timely requests for vehicle / sensor / log data through counsel.
Evidence to Preserve After an AV Crash
Photograph the scene, vehicle positions, and any Waymo or other fleet markings if you can do so safely. Save the police report number, witness contacts, and early medical records. Note nearby cameras before footage is overwritten. Through counsel, request vehicle and sensor data early — fleet “investigation” timelines are not designed around your claim.
Do not rush a recorded statement to the fleet carrier. Those calls are often used to lock in speed, distraction, or “I was fine” narratives before the medical picture is clear. Talk to counsel first.
Comparative Fault Still Applies
Texas uses modified comparative negligence. Your recovery can be reduced by your share of fault, and you are generally barred if you are more than 50% responsible. Carriers in AV files may argue sudden stops, shared blame at intersections, or that you should have anticipated the vehicle’s path. Do not accept their first fault split as fact. More detail: partly at fault car accident in Texas.
First-Party Coverages and Denials
Your own PIP, MedPay, or UM/UIM may still matter while manufacturer, fleet, or third-party coverage is sorted. A soft denial or a long fleet investigation does not end the claim. If a carrier has already said no, read can insurance deny my claim in Texas. Coverage basics: Texas PIP, MedPay, and UM/UIM.
Deadlines Do Not Pause for Fleet Investigations
Most Texas personal injury lawsuits must be filed within two years of the injury. A Waymo or robotaxi claims process does not stop that clock. Details: Texas personal injury statute of limitations. Call sooner rather than later if medical care is ongoing or the other side is already taking statements.

Austin Waymo & Robotaxi Accident FAQ
Can I sue Waymo after an Austin crash?
Injured people can pursue a claim after an Austin Waymo or robotaxi crash. Who belongs on the claim — manufacturer, fleet / operator, another driver, or a mix — depends on the facts. I work from the evidence in your file.
I was in a crash with a Tesla robotaxi in Austin. Is that the same as a Waymo claim, and who pays?
In most ways, yes. I handle it like any other robotaxi crash. The questions are what the vehicle did, who was operating the service, and whether another driver or a vehicle problem played a part. Depending on the facts, responsibility can fall on the company running the robotaxi service, the vehicle or software maker, another driver, or a mix. Which insurance pays depends on who’s responsible, and I don’t assume one company’s answer before I’ve seen the evidence. The vehicle’s video and driving data matter a lot, so ask a lawyer about requesting that it be preserved quickly. Call (512) 872-2264.
Does it matter if there was a person in the Tesla robotaxi?
It can. Whether anyone was in the vehicle, what their role was, and whether they could have stepped in can all be part of the investigation. I find out who was aboard and what they did, along with the vehicle’s own data, rather than guessing from the outside.
What if I hit a driverless car — do I still have a claim?
Possibly. Comparative fault and the other side’s conduct still matter. Hitting an AV does not automatically erase a claim if the vehicle or another party contributed. I evaluate the crash report, scene evidence, and available vehicle data before accepting the other side’s fault narrative.
How is a Waymo / robotaxi case different from Uber or Lyft?
Uber and Lyft claims typically turn on a human driver’s app status and layered TNC insurance. Robotaxi claims focus on manufacturer, fleet / operator, and related parties when the facts support it. Different evidence, different claim handlers. For human-driver rideshare crashes, see Austin Uber & Lyft accident lawyer.
What evidence should I preserve after a robotaxi crash?
Scene photos and video, vehicle identification and fleet markings, the police report, witness names, medical records, and timely counsel-directed requests for vehicle / sensor / log data. Do not rush a recorded statement to the fleet carrier.
How long do I have to bring an AV injury claim in Texas?
Most injury lawsuits must be filed within two years of the crash. Fleet investigations do not extend that deadline. Read Texas personal injury statute of limitations and call if you are unsure which clock applies.
